Yachting, Social, Economic - The Epilogue?

Since March 2017, ECPY has mobilized against the application of Article 31 of the social security code which obliged the French resident sailors to be affiliated to the ENIM, regardless of the flag of the vessel and where they were embarked.

This resulted in a dramatic situation where French resident sailors were excluded from the jobs on board the yachts concerned and where the yachts had left French waters for Italy or Spain, thus emptying the order books of the shipyards and repairs for this winter.

At the time, some organizations had welcomed from the begging what they considered to be a social advance. ECPY has always thought that art 31 was a disastrous provision in terms of employment and economy and we have not changed opinion!

After many contacts, meetings since spring with the many ministries concerned and especially the services of the Ministry of Transport, the services of the Prime Minister, we obtained today that the yachting is excluded from the provisions of Article 31.

Seafarers will have the right to opt between ENIM and one or other schemes that are not known to date.

It’s provisions will appear in the law of social security finance scheduled to be voted in November 2018.

We have made a big step forward, the question that remains to be negotiated is what will be the optional plans to the ENIM that the sailor will be able to choose from?

We are actively working on clarifying this point and we will not fail to keep you updated. We were also told that there were no plans to carry out any controls on the vessels until the new provisions are finalized.

We believe that the decisions taken will soon be fruitful, that the French resident sailors will find jobs, that the yachts will return… This is what ECPY is working for.

Depuis le mois de Mars 2017, ECPY s’est mobilisé contre l’application de l’article art31 du code de la sécurité sociale qui faisait obligation d’affilier à l’ENIM les marins résidents français quelque soit le pavillon du bateau où ils étaient embarqués. Cela avait généré une situation dramatique ou les marins résidents français étaient exclus des emplois à bord des yachts concernés, et où les yachts avaient quittés les eaux françaises pour l’Italie ou l’Espagne, vidant ainsi les carnets de commande des chantiers et réparations pour l’hiver.

Certains et certaines organisations s’étaient félicités à l’époque de ce qu’ils considéraient depuis le début comme une avancée sociale, ECPY a toujours pensé que l’art 31 était une disposition désastreuse au niveau de l’emploi et de l’économie, nous n’avons pas changé d’opinion !

Après moults contacts, réunions depuis le printemps avec les nombreux ministères concernés et notamment les services du ministère des transports, les services du 1er ministre, nous avons obtenu aujourd’hui que le yachting soit exclu des dispositions de l’art 31.

Les marins vont avoir le droit d’opter entre l’ENIM et un ou d’autres régimes qui ne sont pas connus à ce jour. C’est dispositions figureront dans la loi de finance de sécurité sociale prévue d’être votée en novembre 2018.
Nous avons fait un grand pas en avant, la question qu'il reste à négocier est quels vont être les régimes optionnels à l’ENIM que le marin pourra choisir ? nous nous efforçons à partir d’aujourd’hui de clarifier ce point et nous ne manquerons pas de vous tenir au courant.

Il nous a par ailleurs été indiqué qu’il n’était pas prévu d’effectuer de vérification des navires tant que les nouvelles dispositions n’ont pas été arrêtées.

Nous pensons que les décisions prises porteront leurs fruits rapidement, que les marins résidents français vont retrouver des emplois, que les yachts vont revenir... c’est en tout cas ce à quoi ECPY travaille.
